End User Licence Agreement

This End User Licence Agreement ("EULA") governs your licence to use the ResQBag mobile application. It is an agreement between you and ResQbag Technologies only — not with Apple Inc. or Google LLC. Where you obtained the app from the Apple App Store, Apple’s Licensed Application End User Licence Agreement also applies, and in the event of a conflict the more protective term for you prevails.

1. Licence Grant

ResQbag Technologies grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the ResQBag application on any device that you own or control, solely for your personal, non-commercial use of the ResQbag food-rescue marketplace. This licence is granted, not sold; ResQbag and its licensors retain all right, title, and interest in the application.

2. Scope and Restrictions

You may not, and may not permit any third party to:

Copy, modify, translate, or create derivative works of the application
Reverse engineer, decompile, or disassemble the application, except to the limited extent this restriction is prohibited by applicable law
Rent, lease, lend, sell, sublicense, or otherwise distribute the application
Remove, obscure, or alter any proprietary notice or attribution
Use the application to build a competing product, to scrape listings or merchant data, or to place orders you do not intend to collect
Circumvent, disable, or interfere with security, rate-limiting, or authentication features
Use automated means (bots, scripts, scrapers) to access the Platform

3. Consent to Use of Data

You agree that ResQbag may collect and use technical data and related information — including device identifiers, crash diagnostics, and location where you have granted permission — to support and improve the application. This use is governed by our Privacy Policy and the DPDP Act, 2023. We do not track you across other companies’ apps or websites, and we do not sell your personal data.

4. Third-Party Services and Content

The application surfaces content supplied by Merchants (listings, photographs, descriptions, pickup windows) and relies on third-party services (payment gateway, maps, messaging, crash reporting). ResQbag does not warrant the accuracy of Merchant-supplied content and is not responsible for third-party services. Merchant content is subject to our Content Moderation Policy, and you may report any listing you believe is inaccurate or objectionable.

5. Term and Termination

This EULA is effective until terminated. It terminates automatically if you breach any of its terms, and you may terminate it at any time by deleting your account and uninstalling the application. On termination, all rights granted to you end and you must cease all use of the application. Sections 6, 7, and 8 survive termination.

6. No Warranty

The application is provided "as is" and "as available", without warranty of any kind to the maximum extent permitted by law. ResQbag does not warrant that the application will be uninterrupted, error-free, or free of harmful components, nor that any surplus food will be available at any given time. Nothing in this clause limits your non-excludable rights as a consumer under the Consumer Protection Act, 2019.

7. Limitation of Liability

To the maximum extent permitted by law, ResQbag’s total aggregate liability arising out of or relating to the application is limited to the greater of the amount you paid to ResQbag in the six months preceding the claim, or ₹5,000. ResQbag is not liable for indirect, incidental, special, consequential, or punitive damages. Liability for food safety rests with the Merchant under its FSSAI obligations, as set out in the Terms.

8. Third-Party Beneficiary

You acknowledge that Apple Inc. and its subsidiaries are third-party beneficiaries of this EULA where you obtained the app from the App Store, and that Apple has the right to enforce this EULA against you. Apple has no obligation to furnish maintenance or support for the application and is not responsible for addressing any claim relating to it, including product liability, regulatory non-compliance, or intellectual-property infringement claims — those are ResQbag’s responsibility.

9. Export and Legal Compliance

You represent that you are not located in a country subject to a comprehensive trade embargo, and that you are not on any restricted-party list. You must comply with all applicable Indian and international laws when using the application.
